NHRC asks Chief Secretary, Rajasthan to arrest DM, Bikaner for disobeying Commission’s directions
New Delhi, 19th November, 2013

            The National Human Rights Commission has taken a serious view of the casual and mechanical approach adopted by the District Magistrate, Bikaner, Rajasthan, which is indicative of willful disobedience of its directions.  Therefore, it has asked the Chief Secretary, Government of Rajasthan to arrest and bring the DM, Bikaner before the Commission on 28th January, 2014 at 03:00 p.m. 

            He has also been asked to return this warrant duly executed on or before 21st January, 2014 with an endorsement certifying the day on which and the manner in which, it has been executed or the reason why it has not been executed.  The Chief Secretary is further directed to release the said District Magistrate, Bikaner on bail of Rs.500/- only with one surety of the like amount on his undertaking to appear before the Commission on the given date.

            The matter relates to the death of an under trial prisoner, Kani Ram S/o Niku Ram, on 26th November, 2011, in the custody of Central Jail, Bikaner.  Several letters and reminders were sent to the DM, Bikaner, calling upon him to submit the requisite reports in the matter, which he did not provide.  The Director General (Investigation) of the NHRC finally apprised the Commission of the non-responsive attitude of the said DM.

            The Commission has observed that the post-mortem report cannot said to be a complete document to ascertain the cause of death.  In the absence of inquest proceedings and opinion of the Medical Board, the Commission has not been able to know the final cause of the death of Kani Ram.    

            Accordingly, conditional summons w issued in his name to submit requisite reports on or before 23rd August, 2013, failing which he was required to appear before the Commission in person on 30th August, 2013.  But he did not fully comply with the Commission’s directions.
